I just checked it out and yes that is my pic, also the fact they are using to sell cd's on another site. Gonna get this taken care of quick

I also have the exact same pic that was used in a couple of photo contests. Won 3rd place on aquahobby last year, and 1st place on the OKCAA site.

You've got to get it sorted. I would be tempted to purchase the CD they are selling on ebay just to see if they have used any others of yours then contact ebay and tell them that they are contravening copyright. It is a bit of a minefield, but something can be done. Don't let them get away with it.

The point is that no one should use anyone elses photo without permission, especially when they gain financially from it.

It doesn't matter how many times a photo comes up on a search, it doesn't mean it's copyright free. If you want copyright free pictures then you should search specifically for them, or, get the photo owners permission to use it.

At the end of the day it's theft.

you havet to file for copywrite!!!

after reading his reply to susan kat I hope you guys can see he is just another fishkeeper whos trying to bring info to the people on ebay that dont use forums!

(I have asked forum members if they have any pics of there fish I can use! several lots of pics were sent to me!)

these pics were sent a long time ago!
going back to the begining of last year?

I have not intetionly used your copywrite pic!!!! as I asked members for pics of their fish! and I just used what was sent assuming it was pics of their fish!

I will intantly remove it from my listing and disk or with your permission carry on using it!

Doesn't matter whether he is a good guy or not, or whether you know him or not. He is potentially using someones photo without consent, end of subject. It is his responsibility to ensure that the right person has given their consent.

If I post any picture online, it doesn't automatically give anyone the right to use it. Copyright needn't be sought as good manners should prevail. However, this isn't always the case.

Maybe in future we should all use your photos to sell our fish with?? Misleading huh??

I have had several people ask me for permission to use my photos on their websites all the time, and yes I did give this lad permission to use it for his website. I DID NOT give him permission to use it to make money off it. If he had asked if he could I would probably had said yes as long as my name is given for credit. Same goes for use on any website.

In fact that photo has been used in our state club calender.

Yes there is a copywrite law on use of peoples photos even on the internet, and even without me copywriting my photos. If anyone would like more info on this just research the berne convention.

I'm not a hard !@$ but I do wish to be acknowledged for any photos of mine, If I wanted to push it I can make him pay royalties on all of his sales. This is according to my attorney. And yes I do have a private attorney.

Right i think a few poeple need to chill a little here.....
The guy has been given the pic by somebody else and they may have told him that he could use it as it there's....
